Nuxsol provides VOIP and SMS campaign services, including but not limited to DID numbers, CLI services, inbound/outbound calling, API access, and SMS/10DLC/TFN/Shortcode solutions. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

3. Account Registration

To use our services, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

4. Payment Terms

You agree to pay all fees associated with your use of our services. Fees are non-refundable except as required by law or as explicitly stated in these terms. We may change our fees at any time with notice to you.

5. Acceptable Use

You agree not to use our services for any illegal or unauthorized purpose. You must comply with all applicable laws and regulations, including those related to telecommunications, marketing, and data privacy.

6. Prohibited Activities

The following activities are strictly prohibited:

  • Sending messages to recipients who have not opted in
  • Sending messages containing illegal, harmful, or offensive content
  • Attempting to bypass or manipulate our systems or security measures
  • Engaging in any activity that disrupts or interferes with our services

7. Termination

We reserve the right to terminate or suspend your account at any time for violation of these terms or for any other reason at our discretion.

8. Limitation of Liability

To the maximum extent permitted by law, Nuxsol shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Changes to Terms

We may modify these terms at any time. We will notify you of any material changes. Your continued use of our services after such modifications constitutes your acceptance of the modified terms.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

1. 10DLC Compliance

All users of our 10DLC services must comply with the following requirements:

  • Register your brand with The Campaign Registry (TCR)
  • Register each messaging campaign with accurate information
  • Only send messages to recipients who have explicitly opted in
  • Include clear opt-out instructions in your messages
  • Honor opt-out requests promptly
  • Maintain records of consent for at least two years

2. TCPA Compliance

The Telephone Consumer Protection Act (TCPA) regulates telemarketing calls, auto-dialed calls, prerecorded calls, text messages, and unsolicited faxes. To comply with TCPA:

  • Obtain prior express written consent before sending marketing messages
  • Do not send messages outside of permitted hours (8 AM to 9 PM local time)
  • Maintain a Do Not Call list and honor opt-out requests
  • Include your identity and contact information in messages

3. GDPR Compliance

If you collect or process data from individuals in the European Union, you must comply with the General Data Protection Regulation (GDPR):

  • Obtain explicit consent before sending messages

  • Termination of your Nuxsol account
  • Legal penalties and fines
  • Damage to your brand reputation
  • Blocking of your messages by carriers
